Title: Assistant City Attorney

 FLSA Status: Exempt

BRIEF DESCRIPTION:

The purpose of this position is to defend the city, its officers and employees in civil litigation, to prepare documents, investigate charges, and to comply with all local, state and federal legislation.  This is accomplished by advising the city on legal issues, filing pleadings and motions, defending the city in lawsuits, engaging in settlement and mediation discussions, and minimizing all legal and risk exposures.  Other duties include assisting with land use issues, drafting contracts, resolutions and ordinances, reviewing documents, and advising departments and staff.

Advises the city on legal matters by reviewing and approving documents, responding to requests and inquiries, composing documents, contracts, resolutions and ordinances, and meeting with departments and staff.

Investigates charges by reviewing case information, interviewing witnesses, conducting legal research, preparing disclosure statements, gathering facts, applying case law, and recommending relevant courses of action.

Represents the city at meetings and in court by reviewing documents, drafting correspondence, preparing discovery documents, coordinating and/or drafting responses to inquiries or legal pleadings, preparing briefs, and recommending appropriate settlements.

Prevents risk by working with employees, advising staff of legal issues, providing settlement input, supervising internal investigations, and advising elected officials on issues and/or pending litigation.

Supervises staff by planning and supervising daily tasks and activities, establishing procedures and guidelines, evaluating assigned services, coaching for performance improvement and recommending personnel actions.

JOB REQUIREMENTS:

-Description of Minimum Job Requirements-

Formal Education

Work requires specialized knowledge in a professional or technical field.  Work requires professional level of knowledge of a discipline equivalent to that which is acquired in a Masters degree or Doctorate level of study.

Experience

Over three years up to and including five years experience.

Supervision

Work requires the occasional direction of helpers, assistants, seasonal employees, interns, volunteers or temporary employees.

Human Collaboration Skills

Recommendations regarding policy development and implementation are made and/or recommended.  Evaluates customer satisfaction, develops cooperative associations, and utilizes resources to continuously improve customer satisfaction.

Freedom to Act

The employee normally performs the duty assignment according to his or her own judgment, requesting supervisory assistance only when necessary. Special projects are managed with little oversight and assignments may be reviewed upon completion. Performance reviewed periodically.

Technical Skills

Advanced: Work requires advanced skills and knowledge in approaches and systems, which affect the design and implementation of major programs and/or processes organization-wide. Independent judgment and decision-making abilities are necessary to apply technical skills effectively.

Budget Responsibility

Position has limited fiscal responsibility.  May assist in the collection of data in support of recommendations for departmental budget allocations.  May monitor division or program/project level budget and expenditures.

Reading

Advanced - Ability to read literature, books, reviews, scientific or technical journals, abstracts, financial reports, and/or legal documents.  Ordinarily, such education is obtained in at the college level or above. However, it may be obtained from experience and self-study.

Math

Intermediate - Ability to deal with system of real numbers; practical application of fractions, percentages, ratios/proportions and measurement. Ordinarily, such education is obtained in high school up to college. However, it may be obtained from experience and self-study.

Writing

Advanced - Ability to write editorials, journals, speeches, manuals, or critiques.  Ordinarily, such education is obtained in at the college level or above. However, it may be obtained from experience and self-study.
