a)            Approve Contract Amendment No 4, Guaranteed Maximum Price No. 3 (GMP#3), in an amount not to exceed $762,104.19 with Ames Construction, Inc. for construction services associated with the construction of Happy Valley Road widening from 75th Avenue to Lake Pleasant Parkway for Sunrise Mountain water and wastewater improvements (LCON06407D); and

b)            Approve a budget transfer in the amount of $186,182.15 from the General Fund Contingency Account to the Outside Sources Fund Water System Account and in the amount of $575,922.04 from the General Fund Contingency Account to the Outside Sources Fund Wastewater System Account.

4R         Design Principles and Guidelines Update

Discussion and possible action to concur with the Design Standards Advisory Board's recommendation and adopt ORD. 08-22 approving the new Design Principles and Guidelines document, a comprehensive revision to the existing design standards and encompassing architectural, site design and thematic elements. 5R         Intergovernmental Agreement, State of Arizona, State Route 303 Improvements, Happy Valley Parkway to  Lake Pleasant Parkway

Discussion and possible action to:

a)            Adopt RES. 08-107 approving an Intergovernmental Agreement in the amount of $5,963,574 with the State of Arizona for the construction of improvements to State Route 303 Loop (SR303L) from Happy Valley Parkway to Lake Pleasant Parkway (LCON15508); and

b)            Approve a budget transfer in the amount of $198,968 from the Loop 303 Interchanges Project, Half-Cent Sales Tax Fund, Street System Account to the Loop 303 Trail Underpasses Project, Half-Cent Sales Tax Fund, Park Improvements Account.

6R         Intergovernmental Agreement, State of Arizona, State Route 303 Improvements, Agua Fria River to Interstate 17

Discussion and possible action to:

a)            Adopt RES. 08-108 approving an Intergovernmental Agreement in the amount of $2,633,320 with the State of Arizona for the construction of improvements to State Route 303 Loop (SR303L) from the Agua Fria River to Interstate 17 (LCON15608);

b)            Authorize the use of reserves from the Water Expansion Fund and approve a budget transfer in the amount of $201,577 from the Water Fund Contingency Account to the Loop 303 Waterline Crossing Project, Water Expansion Fund, Water System Account;

c)            Approve a budget transfer in the amount of $166,568 from the Loop 303 Interchanges Project, Half-Cent Sales Tax Fund, Street System Account to the Loop 303 Trail Underpasses Project Half-Cent Sales Tax Fund, Park Improvements Account; and

d)            Authorize the use of reserves from the Half-Cent Sales Tax Fund and approve a budget transfer in the amount of $233,375 from the Half-Cent Sales Tax Fund Contingency Account to the Loop 303 Trail Underpasses Project, Half-Cent Sales Tax Fund, Park Improvements Account.

7R         Intergovernmental Agreement, State of Arizona, State Route 303 Improvements, Happy Valley Parkway to  Lake Pleasant Parkway

Discussion and possible action to adopt RES. 08-109 approving an Intergovernmental Agreement in the amount of $544,958 with the State of Arizona for the design and construction of improvements to State Route 303 Loop (SR303L) from Happy Valley Parkway to Lake Pleasant Parkway (Westwing Access/Vistancia Extension). 8R     Intergovernmental Agreement, Maricopa County, City of El Mirage, City of Glendale and City of Peoria, Northern Parkway Improvements, State Route 303 Loop to US 60

Discussion and possible action to approve an Intergovernmental Agreement between Maricopa County, the City of El Mirage, the City of Glendale and the City of Peoria for improvements to Northern Parkway, from State Route 303 Loop to the US 60. (LCON15808)

9R     Intergovernmental Agreement, Maricopa County, City Surprise and City of Peoria, Agua Fria Truck Route Study

Discussion and possible action to:

a)            Approve an Intergovernmental Agreement between Maricopa County, the City of Surprise, the City of Peoria and Arizona Rock Products Association to identify and define responsibilities for the preparation of the Agua Fria River Truck Route Study (LCON15908);

b)            Authorize the use of reserves; and

c)            Approve a budget transfer in the amount of $25,000 from the General Fund Contingency Account to the General Fund Capital Engineering Division, Other Professional Services Account for the City’s proportionate share for the cost of the study.

10R   Loan Repayment Agreement, Arizona Transportation Board, Loop 101 and Union Hills Drive Traffic Interchange Widening Project

Discussion and possible action to authorize the City Manager to sign the Loan Repayment Agreement with the Arizona Transportation Board for the acceleration of the Loop 101 and Union Hills Drive Traffic Interchange Widening project. (LCON08607A)

11R      Contract, Buddy Property Holdings 2, LLC, Property Acquisition, 83rd Avenue and Madison Street

Discussion and possible action to:

a)         Authorize the City Manager to execute a purchase contract with Buddy Property Holdings 2, LLC for the purchase of 6,972 square feet of property located at the southeast corner of 83rd Avenue and Madison Street (LCON16008);

b)         Authorize the use of reserves from the Economic Development Opportunity Fund; and

c)         Approve a budget transfer in the amount of $63,700 from the Economic Development Contingency Account to the Economic Development Land Account.

12R      Contract Amendment, Grand Avenue Peoria Holdings, L.L.C., Oldtown Redevelopment Project, 83rd Avenue and Washington Street

Discussion and possible action to authorize the City Manager to execute an amendment to the Ground Lease Agreement with Grand Avenue Peoria Holdings, L.L.C. for the Oldtown redevelopment project at 83rd Avenue and Washington Street. (LCON07905A)

13R      Authorize Expenditure, CS Construction, Inc., Traffic Signal Construction, 95^th Avenue and Lake Pleasant Parkway

Discussion and possible action to authorize an expenditure of funds in the amount of $327,789.33 to CS Construction, Inc., utilizing existing Job Order Contract No. 4, Traffic Signals at Various Locations, between the Town of Gilbert and CS Construction, for the construction of the 95^th Avenue and Lake Pleasant Parkway traffic signal.

14R      Primary and Secondary Property Tax Levies, Fiscal Year 2009

Discussion and possible action to adopt RES. 08-110 and ORD. 08-23 adopting the City of Peoria, Arizona Primary and Secondary Property Tax Levies for Fiscal Year 2009.

15R      Street Light Improvement District and Maintenance Improvement District, Tax Levies, Fiscal Year 2009

Discussion and possible action to adopt ORD. 08-24 and ORD. 08-25 adopting Street Light and Maintenance Improvement District Tax Levies for Fiscal Year 2009.
