According to Arizona Law, a crime victim is the
person against whom a criminal offense has been
committed or, if the person is killed or
incapacitated, the person's spouse, parent, child,
sibling, grandparent, legal guardian or other lawful
representative may exercise the victim’s rights.
Persons who are in custody for an offense or are the
accused in an offense are not considered victims.
For the purposes of victim rights, a
criminal
offense is Conduct that gives a peace officer or
prosecutor probable cause to believe that either a
felony has been committed, or that a misdemeanor
involving physical injury, the threat of physical
injury, or a sexual offense has occurred. As such,
victims’ rights would apply to any individual victim
of any felony, or individual victims of misdemeanors
fitting this description.
