Criminal Division
The Peoria City Prosecutor’s Office is responsible for prosecuting misdemeanor violations of Arizona Statutes and the Peoria City Code that occur within the City of Peoria. We handle all criminal cases filed in the Peoria Municipal Court, including cases appealed to the Superior Court, Court of Appeals and Supreme Court. We strive to serve the interests of justice in our handling of cases. Our office also acts as legal advisor to the Police Department and other city departments on criminal and related matters.
The Prosecutor’s Office is a division of the City Attorney’s Office. Although we are located in the Municipal Court building, we are not a part of the Court. We represent the State in cases before the Municipal Court.
The maximum penalties for a misdemeanor offense are: 6 months jail, $2,500 fine plus 80% surcharges, 3 years probation (5 years for Driving Under the Influence (DUI's). Recently, Arizona enacted some of the strictest DUI laws in the nation. The minimum penalties under these laws are:

| DUI - blood alcohol level of .15 to .1999 |
30 days in jail, fines & ignition interlock |
| DUI - blood alcohol level of 0.08 to .1499 |
10 days in jail, fines & ignition interlock |
The Court is required to impose in addition to all fines, the cost of incarceration, which is currently $188.00 for the first day and $73.00 for every additional day.
